The Court of Justice of the European Union (CJEU) issued its decision in the case C-360/13 Public Relations Consultants Association Ltd v Newspaper Licensing Agency Ltd and Others (the Meltwater case). The Court was (in this case) asked whether temporary copies made while browsing websites fell under the Article 5(1) of the Copyright Directive (2001/29/EC).

 The Court concluded (after analysis of the issue under the Article 5(1) and also under the three-step test laid down in the Article 5(5)) that on-screen copies and cached copies made by end-users when viewing a website fall under the exception for temporary reproductions, and satisfy the conditions of the three-step test. Therefore, such copies may be made without the authorization of the right holders.
