EC - Digital Single Market package

The European Commission published first Digital Single Market package following the adoption of the Digital Single Market Strategy in May.
It includes four initiatives relevant for the music industry:
- Communication – Towards a modern, more European copyright Framework.
The Communication looks at as territoriality and cross border access, exceptions, Value Gap, and enforcement. It will be followed by a legislative proposal on copyright. The Commission also announces an initiative on the role of online platforms.
- A proposed Regulation on ensuring the cross-border portability of online content services in the internal market.
The proposal imposes an obligation on online services providing copyright protected content, to ensure that the subscribers of the service in one Member State can access and use the content when they are temporarily present in another Member State.
- A proposed Directive on contracts for the supply of digital content.
This proposal concerns services supplying content to end-users (B2C) and focuses on delivery and redress for consumers.
- A consultation on the review of the Enforcement Directive (IPRED).
This consultation includes questions on the review of the Enforcement Directive including on injunctions, cross-border enforceability of measures, costs, damages etc.

Today’s announcement by the Commission on its plans to for copyright is an opportunity to champion Europe’s creative sectors and their digital growth. The music industry is already 34% digital in Europe, and consumers have access to over 43 million songs on 200 services. Portability has been a long-standing feature of our digital services, enabling consumers to access their content where, when and how they want.
Today’s Communication usefully focuses on several areas that need to be addressed, including a review of the role of online platforms in relation to copyright. The Commission also recognises the need to properly enforce and protect IP rights in Europe in order to allow the digital market to grow.
